Shop Terms of Sale

These terms (the “Terms”) set out the conditions for using the online shop (the “Service”) that KISS Saikai Co., Ltd. (“we”) provides on this website. Customers who buy works through the Service (“you”) agree to these Terms.

Article 1 (Scope)

These Terms apply to every relationship between you and us concerning the Service.

Specific rules we publish for the Service, such as the Shopping Guide, form part of these Terms and prevail where they conflict.

Article 2 (Contract of sale)

A contract of sale is concluded when you apply to buy and we accept. For card and wallet payments, acceptance takes place when payment is completed; for bank transfer, when we send our e-mail with the payment details.

Ownership of the work passes to you when we hand it to the carrier.

We may cancel a contract if you breach these Terms, if delivery cannot be completed because the address is unknown or you are absent for a long period, or if the relationship of trust is otherwise lost.

Article 3 (Intellectual property)

Copyright and other intellectual property rights in the artwork photographs and other content of the Service belong to us, the artist or other rightful holders. Buying a work does not transfer its copyright. You may not copy, reproduce, alter or otherwise reuse the content without permission.

Article 4 (Prohibited conduct)

When using the Service you must not:

break the law or public order; engage in conduct connected with crime; infringe our or others’ intellectual property or other rights; damage or obstruct our servers or networks; gain or attempt unauthorised access; impersonate others; provide benefits to anti-social forces; or do anything else we reasonably consider inappropriate.

Article 5 (Suspension)

We may suspend or interrupt all or part of the Service without notice for maintenance, natural disasters or other force majeure, network failures or other unavoidable reasons.

Article 6 (Limitation of liability)

We are not liable for damage arising from the Service except where caused by our wilful misconduct or gross negligence. Where your contract with us is a consumer contract under the Consumer Contract Act, this exclusion does not apply; even then, our liability for damage caused by our negligence (other than gross negligence) is limited to the price you paid for the work.

We are not responsible for transactions, communications or disputes between you and third parties in connection with the Service.

Article 7 (Changes to these Terms)

We may change these Terms when necessary. Changed Terms apply from the time they are published on this website; contracts concluded earlier remain under the earlier Terms.

Article 8 (Personal information)

When you buy a work we collect your name, e-mail address, telephone number, delivery address and order details, and use them to confirm, charge, ship and follow up on your order.

Card and wallet payments are made on the page of Stripe, Inc. (payment processor); card numbers are not provided to us. To ship the work we give the carrier your name, delivery address and telephone number. These providers may store data on servers outside Japan.

Everything else follows our Privacy Policy.

Article 9 (Governing law and jurisdiction)

These Terms are governed by the laws of Japan. The United Nations Convention on Contracts for the International Sale of Goods does not apply to the Service.

The Nagasaki District Court has exclusive jurisdiction in the first instance over any dispute concerning the Service.
