Horizon Castle Membership Terms

Article 1 — Purpose

These Membership Terms set out the basic rules governing membership in Horizon Castle, operated by KISS Saikai Co., Ltd. (“Horizon Castle” or “we”), including membership status, use of facilities and services, Privileges and other member benefits.

Article 2 — Membership Plans

1. Horizon Castle may offer different membership plans for individuals or corporations.

2. Fees, terms, benefits, Privileges, reservation conditions and other specific details are governed by the applicable plan materials, application documents and other conditions presented by Horizon Castle.

3. Where a specific plan expressly provides terms that differ from these Membership Terms, those specific plan terms will apply to that plan.

Article 3 — Admission

1. Applicants must apply through the method designated by Horizon Castle and receive approval.

2. Approval may take into account the purpose of the membership program, intended use, capacity and operational considerations.

3. Persons or organizations connected with organized crime or other antisocial forces are not eligible for membership.

Article 4 — Membership Status

1. Membership belongs to the individual or corporation approved by Horizon Castle.

2. Membership status itself may not be transferred, resold, pledged or otherwise disposed of to a third party.

3. Where a corporate membership allows registered users, the applicable plan will define the permitted scope.

4. Membership does not create ownership, co-ownership, shareholder rights, deposit repayment rights or any similar proprietary interest in Horizon Castle or its operator unless expressly provided in a separate written agreement.

Article 5 — Privileges and Benefits

1. The scope and conditions of Privileges and other member benefits (collectively, “Member Benefits”) are governed by the applicable plan or individual agreement.

2. Unless expressly permitted, member benefits may not be converted into cash, resold or commercially transferred.

3. Loss, theft or suspected unauthorized use should be reported promptly.

4. Horizon Castle may apply reasonable identity verification and measures to prevent unauthorized use when Member Benefits are exercised.

Article 6 — Fees and Payment

1. Membership fees, service charges and payment methods are governed by the applicable plan or the conditions presented at the time of booking.

2. Taxes are handled in accordance with applicable law and the price presentation.

3. Refunds of paid fees are governed by applicable law and the relevant plan or booking conditions.

Article 7 — Reservations

1. Accommodation, exclusive use, cultural experiences, transfers, dining, local experiences and other services generally require advance reservation or consultation.

2. Membership or reservation priority does not guarantee a particular date, room, instructor, experience or service.

3. Services involving instructors, specialists, interpreters, transport operators, local partners or other third parties may be unavailable on the requested date because of scheduling, weather, transport, legal, venue or other conditions.

4. A reservation becomes confirmed only when Horizon Castle issues a confirmation.

5. Where a requested service cannot be provided, we will, where reasonably possible, propose an alternative date, format or arrangement.

Article 8 — Guests

1. Members may bring guests within the limits of the applicable plan and facility rules.

2. Members are responsible for making their guests aware of these Terms and relevant facility rules.

3. Members may be asked to cooperate reasonably in relation to the conduct of their guests.

Article 9 — Use of Facilities and Services

Members and guests must respect the property, artworks, facilities, natural environment, surrounding community and other users, and follow reasonable instructions from Horizon Castle staff.

Article 10 — Prohibited Conduct

The following is prohibited:

1. unlawful conduct or conduct contrary to public order;

2. conduct that threatens, discriminates against, harasses or unreasonably disturbs others;

3. damage to property, artworks, equipment or the natural environment;

4. unauthorized commercial activity, solicitation, resale or commercial filming;

5. use of, or provision to third parties of, Member Benefits or authentication information contrary to Horizon Castle’s approval or the applicable plan or individual agreement;

6. other conduct that Horizon Castle reasonably considers seriously incompatible with safe or proper operation.

Article 11 — Cancellations and No-Shows

Cancellations, changes and no-shows are governed by the cancellation policy or specific plan conditions presented for the relevant reservation.

Article 12 — Changes to Services

Horizon Castle may reasonably change or temporarily suspend services, methods of delivery, opening hours or available facilities for operational, safety, seasonal, weather, instructor, external partner, legal or similar reasons.

Article 13 — Suspension or Termination of Membership

Membership or benefits may be suspended or terminated where there is a serious breach of these Terms, non-payment, misuse, involvement with antisocial forces, fraud or another reasonable basis making continued membership inappropriate.

Article 14 — Safety and Events Beyond Reasonable Control

1. Services may be affected by weather, natural disasters, transport disruption, infectious disease, government measures, third-party service interruption or other matters beyond our reasonable control.

2. Marine, sporting and outdoor activities may be changed or cancelled based on weather, safety conditions or the decision of the relevant operator.

3. Safety takes priority, and alternative arrangements may be proposed where appropriate.

Article 15 — Liability

To the extent permitted by law, Horizon Castle is responsible for direct and ordinary loss caused by matters attributable to Horizon Castle. Services supplied by independent third parties may also be subject to that provider’s own terms unless Horizon Castle is itself the direct service provider.

Article 16 — Intellectual Property and Photography

1. Artworks, photographs, video, names, logos, materials and other intellectual property belong to the relevant rights holders.

2. Commercial photography, public recording, reproduction of artworks or similar use may require prior permission.

3. Where Horizon Castle records an event for public use, appropriate consent will be obtained where required.

Article 17 — Personal Information

Member information, reservation information and other personal data are handled in accordance with our Privacy Policy and applicable law.

Article 18 — Changes to these Terms

Horizon Castle may reasonably amend these Terms in response to changes in law, services or operations. Material changes will be communicated through the website or another appropriate method.

Article 19 — Governing Law and Jurisdiction

These Terms are governed by Japanese law. Unless applicable law requires otherwise, disputes relating to these Terms or the membership program will be subject at first instance to the competent court having jurisdiction over the location of Horizon Castle’s operator in Nagasaki Prefecture.

Article 20 — Languages

These Terms may be provided in Japanese, English and Traditional Chinese. In the event of an inconsistency in interpretation, the Japanese version will serve as the reference version unless applicable law requires otherwise.
